End User License Agreement (EULA) for CyberGuard mobile application and services.

1. Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and CyberGuard ("Company," "we," "us," or "our") regarding your use of the CyberGuard mobile application, including any related services, features, content, and applications offered by us (collectively, the "Service").

By downloading, installing, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

2. Description of Service

CyberGuard is a cybersecurity awareness application that provides:

  • Daily cybersecurity tips and insights
  • Personalized security recommendations
  • Educational content about cyber threats
  • Security awareness training materials
  • Push notifications for security updates
  • Premium subscription features

The Service is provided "as is" and may be modified, updated, or discontinued at any time without prior notice.

3. Auto-Renewable Subscriptions

Important Subscription Information

Please read this section carefully as it contains important information about billing and cancellation for premium subscriptions.

3.1 Subscription Plans

We offer the following auto-renewable subscription plans:

  • Premium Monthly: $4.99/month
  • Premium Annual: $49.99/year (equivalent to $4.17/month)
  • Premium Lifetime: One-time payment of $99.99

3.2 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel it at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

3.3 Payment and Billing

  • Payment will be charged to your Apple ID account or Google Play account at confirmation of purchase
  • Subscriptions may be managed and auto-renewal may be turned off by going to your Account Settings after purchase
  • No cancellation of the current subscription is allowed during active subscription period
  • Any unused portion of a free trial period will be forfeited when you purchase a subscription

3.4 Cancellation

You may cancel your subscription at any time through your device's subscription management:

  • iOS: Settings > [Your Name] > Subscriptions > CyberGuard > Cancel Subscription
  • Android: Google Play Store > Menu > Subscriptions > CyberGuard > Cancel

Cancellation takes effect at the end of the current billing cycle. You will continue to have access to premium features until the end of your paid period.

3.5 Free Trial

We may offer a free trial period for new subscribers. If you do not cancel during the trial period, your subscription will automatically begin and you will be charged the subscription fee. Free trials are limited to one per user and may not be combined with other offers.

4. User Accounts and Registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as necessary
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

You must be at least 13 years old to create an account. Users under 18 must have parental consent.

5. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights
  • Transmit harmful, offensive, or inappropriate content
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use the Service for commercial purposes without permission
  • Create multiple accounts to circumvent limitations
  • Share your account credentials with others

6. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by CyberGuard and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.1 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.

6.2 Restrictions

You may not modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content or software obtained from the Service.

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

You have the right to request deletion of your personal data at any time through our data deletion request form available at /request-data-deletion.

8. Disclaimers and Warranties

Important Legal Notice

The following disclaimers limit our liability. Please read carefully.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT OF THIRD-PARTY RIGHTS
  • ACCURACY, COMPLETENESS, OR RELIABILITY OF CONTENT
  • UNINTERRUPTED OR ERROR-FREE OPERATION
  • SECURITY OR VIRUS-FREE TRANSMISSION

We do not warrant that the Service will meet your specific requirements or that any security vulnerabilities will be prevented through use of our Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYBERGUARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or business opportunities
  • Business interruption or system downtime
  • Security breaches or cyber attacks
  • Reliance on information provided through the Service

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount paid by you for the Service in the 12 months preceding the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless CyberGuard and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in the app. Upon termination, your right to use the Service will cease immediately.

11.2 Termination by Us

We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11.3 Effect of Termination

Upon termination, all rights and licenses granted to you will cease, and you must discontinue use of the Service. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You and CyberGuard agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by:

  • Posting the updated Terms in the app
  • Sending an email notification to registered users
  • Displaying a prominent notice in the Service

Your continued use of the Service after any changes indicates your acceptance of the new Terms. If you do not agree to the changes, you must stop using the Service.
